Terms

Mochi is built and licensed by an independent developer, trading without a registered company at present. There is no company name or registered address to give yet; when one exists it will be named here and this paragraph will go. In the meantime the person responsible for the data described on this page can be reached at the address below, and answers it. “We” below means that developer.

Your purchase, though, is from Dodo Payments. They are the merchant of record: they take the payment, charge the tax, issue the invoice and appear on your card statement. Their terms cover the transaction; these terms cover the software. If you need a receipt or a VAT invoice, it comes from them — your account page links straight to it.

A paid licence is personal, non-exclusive and non-transferable, and covers 3 Macs. Those are meant to be your machines — a laptop, a desktop, a spare — not one machine each for three people. You can move the licence between Macs whenever you like from your account page.

You may use Mochi for anything you like, personal or commercial. Anything you record, capture, write or export is yours; we claim nothing in it. We never see any of it, with the single exception of text you deliberately send to the writing help by pressing its hotkey — and we do not keep that either. The privacy policy says exactly what happens to it.

You may not:

• share, resell, sublicense or publish your licence key;
• work around the licence check, or the limits of the free version;
• decompile or reverse-engineer the software — except to the extent the law gives you that right regardless, which in the EU and UK includes achieving interoperability.

Sharing a key is the one thing that gets a licence revoked. If that happens we will email you first and refund the unused part.

The free version is free permanently and needs no account, no key and no card. It is not a trial. It includes screen recording capped at two minutes a take.

The trial is 14 days of everything, once per Mac, with no card and no account. When it ends, Mochi becomes the free version — nothing is locked away, and recordings you already made stay on your Mac as ordinary files.

Correction and translation (⌥⇧C and ⌥⇧T) are part of a paid licence and run through a service we operate. There is no API key to create and no separate bill: it is included in the price, and there is no per-use charge for it now or later within a subscription you are already paying for.

The output comes from a language model, so check it before you rely on it. It can be wrong, and it can be confidently wrong. Mochi refuses to apply an answer that looks damaged and shows you the change rather than making it silently, but neither of those is a guarantee of accuracy. Do not use it for anything — legal, medical, financial or safety-related — where a wrong word matters and nobody is going to read it.

What you send and what comes back are yours. We claim no rights in either. We do not keep either. Nothing you send is used to train a model, by us or by anyone we use.

You may not use it to:

• generate or process content that is unlawful where you are, or that we would be breaking the law to transmit;
• drive it from a script, another product, or anything other than Mochi on a Mac you hold a licence for;
• work around the per-licence limits, or share one licence with a group of people.

There is a generous daily allowance per licence. It exists so that one licence cannot be shared with a crowd, not to ration ordinary use — a person writing all day never reaches it, and the app shows you where you are against it rather than surprising you. If you are doing something legitimate that needs more, email us and we will sort it out.

We choose the model, and we change it. Which model answers is our decision and it will change without notice, because that is what lets the feature get better, stay fast, and survive a model being retired by the company that made it. We do not promise any particular model, provider or output style.

This is the one part of Mochi that needs a connection, so it can be briefly unavailable. It is not sold separately and carries no uptime commitment or service credits — but if it is the reason you bought a licence and it does not work for you, the 30-day refund below applies like anything else.

Mochi Pro is $12 a month or $99 a year. Both are subscriptions, and both renew automatically at the end of each period, at the same price, until you cancel. You will be charged on the renewal date without further action from you.

Cancel any time, from your account page or by emailing us. Cancelling stops the next charge; it does not end the period you have already paid for, and Mochi keeps working until that period ends. After that it becomes the free version.

A founding subscription keeps its price for as long as it stays active. Cancel it and the price goes with it.

If a payment fails we will try again over a few days and Mochi keeps working while we do. If it never succeeds, the licence lapses to free.

We may change prices, but never for a subscription already running without telling you at least 30 days before the renewal it would affect — enough time to cancel instead.

Thirty days, no questions. Email support@getmochi.app within 30 days of a charge and we will refund it in full. No form, and we will not ask you to justify it.

If you are a consumer in the EU or UK you also have a statutory 14-day right to withdraw from a distance purchase. Because Mochi is digital and works immediately, starting to use it counts as asking for immediate delivery, which ordinarily ends that right early. Our 30-day promise is more generous than the statutory minimum and we will honour it either way, so in practice you never need to argue about which applies.

We will keep Mochi working on supported versions of macOS and fix what breaks, but we do not promise it is free of defects or that any particular feature will exist forever. The licence server is needed to activate and occasionally re-check a licence; it is designed so a network outage does not stop you working, because your Mac verifies its licence locally. The writing service is the one exception and is covered above — everything else in Mochi runs entirely on your Mac and keeps working if every server we have goes dark.

Mochi is provided “as is” and, to the extent the law allows, without warranties of any kind. Nothing here affects the statutory rights you have as a consumer, which cannot be excluded.

If we are liable to you for something, our total liability is limited to what you paid us in the 12 months before it happened. We are not liable for lost profits, lost data or indirect losses.

Nothing in these terms limits liability that cannot legally be limited — including death or personal injury caused by negligence, fraud, or anything else the law in your country puts beyond the reach of a contract.

Mochi records your screen and can type into other applications when you ask it to. Please keep your own backups of anything that matters.

You can stop using Mochi at any time; cancelling the subscription is the whole of it. We may suspend or end a licence if it is shared publicly, used to break the law, or charged back — and if we do, we will tell you why.

If these terms change materially, we will email everyone with a licence at least 30 days before the change applies. If you do not agree, cancel before then and we will refund the unused part of your period.

No governing jurisdiction is named here yet. Until one is, the law of the country you live in applies and its courts have jurisdiction — which, if you are a consumer, is a protection you would have had regardless of what this clause said. Your purchase is a separate contract with Dodo Payments and is governed by their terms.
